Acknowledgement & Waiver - Conservancy Travel

Acknowledgement: Consistent with your travel insurance policy and CDC guidelines, a COVID test must be administered in Costa Rica before returning to the USA. This test is already set up to be done at the Parador Hotel in Manuel Antonio. This cost is $70USD. This must be paid for by each student individually. Please acknowledge that the participant is aware of this test and cost, the participant will submit to the antigen test and is prepared to pay the required $70USD. Please ensure the exact amount is in USD.

Acknowledgement & Liability Waiver

ACKNOWLEDGMENT AND LIABILITY WAIVER

The undersigned has booked a high school trip to Costa Rica scheduled to begin on July 27, 2021 (the “Trip”) with The International Expeditions Conservancy, Inc., an Alabama not for profit corporation (the “Conservancy”). 

Electronically responding, you as parent or guardian of the participating student, or you as the participant; successors, heirs, personal representatives or assigns, does hereby:

(A) 	acknowledge that the Trip is being organized and provided by the Conservancy and not International Expeditions, Inc. n/k/a Zegrahm Expeditions, Inc., a Delaware corporation registered to transact business in Alabama doing business as “International Expeditions” and with a principal place of business located at One Environs Park, Helena, Alabama 35080 (“International Expeditions”).

(B)	further acknowledge that neither International Expeditions nor any of its owners, officers, directors, employees, contractors, subcontractors or affiliates is in any way affiliated with the Trip or the Conservancy; and that INTERNATIONAL EXPEDITIONS MAKES NO GUARANTY, WARRANTY OR REPRESENTATION, EXPRESS OR IMPLIED, BY OPERATION OF LAW OR OTHERWISE, AS TO THE TRIP, INCLUDING THE QUALITY, SERVICEABILITY, MERCHANTABILITY OR CONDITION OF THE TRIP OR THIRD PARTY SUPPLIER USED FOR THE TRIP, OR ANY OF THEIR FITNESS FOR ANY PARTICULAR USE OR PURPOSE OR ANY OTHER GUARANTY, WARRANTY OR REPRESENTATION OF ANY KIND WITH RESPECT TO TRIP. THE UNDERSGINED HEREBY AGREES THAT NO GUARANTY, WARRANTY OR REPRESENTATION WITH RESPECT TO ANY OF THE FOREGOING HAS BEEN EXPRESSED OR IMPLIED BY INTERNATIONAL EXPEDITIONS. 

 (C)	release, waive, discharge, hold harmless and covenant not to sue International Expeditions, and its owners, officers, directors, employees, contractors, subcontractors and affiliates from any and all claims, actions, or losses for emotional injury, bodily injury,  personal injury, property damage, wrongful death, loss of services, lost profits, consequential, exemplary, indirect or punitive damages or otherwise which may arise out of or occur in connection with the Trip, including, without limitation the actions or inactions of the Conservancy or any of its staff or third party vendors or suppliers or any activities that the undersigned may undertake with the Conservancy or any such third party vendors or suppliers. 

(D)	This Agreement shall be governed by and construed in accordance with the law of the State of Alabama, without regard to the conflicts of laws provisions or principles thereof.
